These Terms & Conditions govern your access to and use of phunga, including our website, mobile application, ordering services, payment services, delivery coordination, and related customer support.

2. Acceptance of Terms
By accessing or using phunga, creating an account, placing an order, making a payment, or using any service offered through the platform, you agree to be bound by these Terms & Conditions, our Privacy Policy, Delivery Policy, and Cancellation & Refund Policy.
If you do not agree with these terms, please do not use the platform.
3. Platform Role
phunga acts as a technology-enabled platform that connects customers with restaurants, food vendors, cloud kitchens, and delivery/service partners. Food preparation, quality, hygiene, packaging, pricing, item availability, and fulfilment are primarily the responsibility of the respective vendor.
phunga may assist with order processing, payment facilitation, customer support, and delivery coordination depending on the service model applicable to a particular order.
4. Account Registration
- You must provide accurate, current, and complete information while registering or placing an order.
- You are responsible for maintaining the confidentiality of your account, login credentials, and OTP verification.
- You agree not to impersonate any person or use another person’s account or contact details without permission.
- We may suspend or restrict access if we suspect fraud, misuse, unlawful activity, or violation of these terms.
5. Orders
- Orders may be placed only for serviceable locations shown in the app or website.
- Menu items, prices, taxes, packaging charges, delivery fees, discounts, and availability may vary by vendor, location, and time.
- An order is considered confirmed only after successful placement, vendor acceptance, and/or successful payment where applicable.
- Vendors may reject or cancel orders due to item unavailability, closing hours, delivery limitations, operational issues, or other valid reasons.
6. Pricing, Taxes, and Charges
Prices shown on phunga may include item price, packaging charges, platform charges, delivery fees, taxes, discounts, and other applicable charges. The final payable amount will be shown before order confirmation.
If applicable, GST or other taxes will be charged as per government regulations. Vendors are responsible for their own tax compliance and issuance of tax invoices wherever applicable.
7. Payments
- Online payments may be processed through authorised third-party payment gateway providers.
- Payment methods may include UPI, cards, net banking, wallets, or other options enabled from time to time.
- phunga does not store full card numbers, CVV, UPI PINs, or banking passwords.
- A payment is considered successful only after confirmation from the payment gateway and verification by our system.
- In case of payment failure, timeout, duplicate payment, or technical issue, the refund process will be handled as per our Cancellation & Refund Policy.
8. Delivery
Delivery timelines are estimates and may vary due to vendor preparation time, customer location, traffic, weather, operational constraints, rider availability, festivals, strikes, restrictions, or other circumstances.
Customers must provide accurate delivery address, contact number, and location details. Failure to provide correct details may result in delay, failed delivery, or cancellation.
9. Cancellations and Refunds
Cancellation and refund eligibility is governed by our Cancellation & Refund Policy. Orders may not be cancellable once the vendor has accepted the order or preparation has started, except where required due to service failure, item unavailability, or other eligible reasons.
10. User Conduct
You agree not to:
- Use the platform for unlawful, fraudulent, abusive, or harmful purposes.
- Place fake orders or misuse discounts, coupons, referral benefits, or payment systems.
- Harass, threaten, abuse, or misbehave with vendors, delivery personnel, support staff, or other users.
- Attempt to damage, reverse engineer, overload, hack, or disrupt the platform.
- Upload or transmit viruses, malicious code, or harmful content.
11. Food Quality, Allergies, and Health
Food items are prepared by independent vendors. Customers are responsible for checking item descriptions, ingredients, food type, spice level, and allergen suitability before placing an order.
If you have allergies, medical dietary restrictions, or special food requirements, please contact the vendor or support before ordering. phunga shall not be liable for allergic reactions or health issues arising from food ingredients, except to the extent required under applicable law.
12. Offers, Discounts, and Promo Codes
- Offers and promo codes may be subject to minimum order value, validity period, user limits, vendor limits, and location restrictions.
- phunga may modify, withdraw, or reject offers in case of misuse, technical error, or suspected fraud.
- Promo codes cannot be exchanged for cash unless expressly stated.
13. Intellectual Property
The phunga name, logo, design, software, content, images, graphics, and platform features are owned by or licensed to phunga/Eramdam Shoppe. You may not copy, reproduce, modify, distribute, or use them without written permission.
14. Limitation of Liability
To the maximum extent permitted by applicable law, phunga shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the platform.
Our liability, if any, shall be limited to the amount paid by you for the specific order giving rise to the claim, except where such limitation is not permitted by law.
15. Force Majeure
phunga shall not be responsible for delay or failure caused by events beyond reasonable control, including natural disasters, severe weather, internet failures, power outages, strikes, transport disruptions, government restrictions, epidemics, riots, or other force majeure events.
16. Changes to Terms
We may update these Terms & Conditions from time to time. Updated terms will be posted on this page with the latest revision date. Continued use of the platform after changes means you accept the updated terms.
17. Governing Law and Jurisdiction
These Terms & Conditions shall be governed by the laws of India. Subject to applicable law, disputes shall be subject to the jurisdiction of competent courts in Imphal, Manipur, India.
